RULES & REGULATIONS:

1. HOW TO ENTER: No Purchase Necessary. All contest entries must be received on or before 11:59 p.m. EST March 1, 2009 (“Contest Closing Date”). To be entered into the contest, visit the Harvey’s website at www.harveys.ca, complete the online entry form, including your name, complete address and daytime telephone number (with area code) and click the submit button and you will be entered in the contest. Enter as often as you wish.

2. PRIZES: There will be a total of five (5) prizes available to be won. Each prize consists of one (1) $100.00 (CDN) Harvey’s Gift Card redeemable at any participating Harvey’s restaurant located in Canada. Gift cards may also be redeemed at participating Kelsey’s, Montana’s, Milestone’s and Swiss Chalet restaurants located in Canada. Prizes must be accepted as awarded, are not transferable and are not convertible to cash. Only one (1) prize may be awarded per person. Gift cards may only be redeemed once.

3. DRAW: Random draws will be conducted by an independent judging organization at or shortly after 12:00 p.m. EST on March 15, 2009 from among all eligible entries received on or before the “Contest Closing Date”. Odds of being selected are dependent on the total number of eligible entries received by the “Contest Closing Date”. Chances of winning are dependent on the total number of eligible entries received by the Contest Closing Date.

4. GENERAL RULES:

a. In order to be declared a winner, selected entrants must correctly answer unaided, a time-limited, mathematical skill-testing question by phone at a predetermined mutually convenient time. The prize will be forfeited and an alternate winner may be selected unless a winner signs and returns, within 10 days of the date of the accompanying cover letter, a standard declaration and release form, confirming eligibility and compliance with the contest rules and releasing Harvey’s, Cara Operations Limited,  and their respective partners and affiliates and their respective advertising and promotional agencies, and the independent judging organization from all liability caused by,  resulting from or arising out of the acceptance or use of the contest prize,  the use of any personal information or the use of merchandise or services purchased in relation to winning a prize. In the event that a selected entrant cannot be contacted within two weeks of the contest draw another entrant will be selected.

b. This contest is open to residents of Canada, over the age of majority in their province of residence, except employees of Harvey’s, Cara Operations Limited, their respective partners and affiliates and their respective advertising and promotional agencies, the independent judging organization, and all persons with whom they are domiciled.

c. All decisions of the independent judging organization are final.

d. Harvey’s, and Cara Operations Limited, and their respective partners and affiliates and their respective advertising and promotional agencies, and the independent judging organization each assume no responsibility for lost, stolen, delayed, damaged, or misdirected entries, or for any failure of the website during this contest, for any problems or technical malfunction of any telephone network or lines, computer online systems, services, access providers, computer equipment, software, failure of any e-mail or entry to be received by Harvey’s on account of technical problems or traffic congestion on the internet or the website or any combination thereof including any injury or damage to an entrant’s, or any other person’s computer, related to or resulting from playing or downloading any material in the promotion. Any attempt to deliberately damage the website or to undermine the legitimate operation of this promotion is a violation of the Criminal and Civil laws of Canada, and should such an attempt be made Harvey’s reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. Harvey’s reserves the right, it its sole discretion, to change the terms of this contest, or to cancel or suspend it at any time, without prior (or any) notice.

e. All entries become the property of Harvey’s and none will be returned. No correspondence will be entered into except with the selected entrants who will be notified by mail or telephone and informed of all necessary arrangements. Entrants, by entering this contest, agree to abide by these contest rules and the decisions of the independent judging organization. Contest winners must consent to the use of their name,  photograph, voice, video footage and/or statements for publicity purposes without compensation, in any future publicity carried out by Harvey’s in connection with this or any similar contest.

f. This contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.

g. Entrants agree that the personal information collected for purposes of this contest can be collected, used and disclosed by Harvey’s in accordance with its privacy policy which is available on its web site.

h.  Any and all taxes assessed as a result of receiving a prize will be the responsibility of the respective winners. Any other costs are the responsibility of the winners.
